There is a phrase I encountered again and again while traveling through Germany, visiting the places where the Holocaust was conceived, administered and remembered. “The Nazis murdered six million Jews.” It is true. But it is also dangerously incomplete. The Nazis did not descend upon Germany from another planet. They were not an alien occupying army that conquered an innocent German population and forced it, at gunpoint, to participate in crimes it abhorred. They were Germans. The government was German. The army was German. The bureaucracy was German. The railways transporting Jews to their deaths were German. The police battalions shooting Jewish mothers and children into pits were German. The industrial companies supplying and profiting from the machinery of conquest were German. And the country in whose name all of this was done was Germany. The Nazis did not descend upon Germany from another planet. They arose from German society and ruled through German institutions. This does not mean that every German was a murderer. It does not erase the courage of German opponents of Hitler: Sophie and Hans Scholl and the White Rose; Dietrich Bonhoeffer; Georg Elser, who nearly assassinated Hitler in 1939; Claus von Stauffenberg and the conspirators of July 20, 1944; and others who resisted and, in some cases, paid with their lives. Their courage deserves remembrance precisely because resistance was possible—and because it was exceptional.

The Seventh Amendment guarantees to every American the right to a jury trial. Judge Michael Moore stripped Rabbi Shmuley Boteach initially of his First Amendment Right to speak out agaist Jew-hatred, and then his Seventh Amendment right to be heard by a jury of his peers. The reason? The rabbi posted on Instagram to disclose the vile, life-threatening antisemtic attack against him by Islamist Faiz Akbar. Yet a jury would not decide liability. The sanctions process decided it instead. Rabbi Boteach had entered the Fontainebleau to work on a speech for his friend Robert F. Kennedy, Jr., whose own father was murdered by Islamist Sirhan Sirhan. Rabbi Shmuley had been confronted and threatened with murder by Faiz Akbar. Millions were sickened by the poisonous hatred of Akbar and his sickening language in the video. Yet Judge Moore, in his shocking ruling finding a Rabbi guilty of defamation without a jury trial, quoted a comedian. A rabbi threatened with murder for wearing a kippa is no laughing matter. And this was no ordinary comedian. It was James Donald Forbes McCann. McCann’s stand-up special Black Israelite includes extensive routines involving Jews, Israel, Gaza, Kanye West and Adolf Hitler. He jokes about being unable to criticize Israel. He engages in Jewish wordplay. He performs a lengthy routine involving Kanye West’s statements about Hitler. The routine ultimately reaches a joke in which McCann refers to Kim Kardashian’s buttocks as “a gas chamber we can all get behind.” McCann also performed a Nazi-themed parody titled The Sound of Nazis and has appeared in the orbit of Tony Hinchcliffe’s Kill Tony, a comedy program repeatedly associated with deliberately provocative racial, ethnic and religious humor. Why would a respected Federal judge quote comedy, let alone an alleged antisemitic comedian, in litigation born from an antisemitic attack against a world-famous rabbi. What has America come to? No First Amendment. No Jury trial. And belittling the sacred memory of the six million? #NeverAgain
