One of the things [34:22] I regret the Republicans haven't done [34:26] is uh to change the makeup of the DC [34:30] lower courts and circuit court and to [34:33] move a lot of these these judges. First, [34:36] we'll remove several of them. You don't [34:37] have to do it through impeachment. just [34:38] eliminate their courthouse and eliminate [34:41] their jurisdiction [34:44] and create [34:46] some of these judgeships and some of [34:47] these courouses outside of the [34:50] Washington DC metropolitan area [34:54] because it has a poisonous effect on [34:56] their brains. [34:59] And that's the case with Judge Kelly, a [35:02] Trump appointee 2017. [35:05] I don't know who recommended him. I [35:07] don't know how he got there. I'd never [35:09] heard of him before, but so be it. Cable [35:12] News Network, CNN [35:15] versus Donald J. Trump. [35:18] It's only eight pages. [35:21] On the afternoon of September 18, 2026, [35:24] President Trump announced in a social [35:26] media post that effective immediately [35:28] was banning the news organizations CNN, [35:31] MS Now, and Politico from the White [35:34] House. And those news organizations [35:36] alleged that over the weekend their [35:38] reporters were denied access to the [35:40] White House and had their hard pass [35:42] press credentials deactivated. [35:45] Plaintiffs the three news organizations [35:47] and three individual reporters sue the [35:49] president and several White House [35:51] officials and move for a temporary [35:52] restraining order at TTRO asking the [35:55] court to order the immediate [35:56] reinstatement of their hard passes [35:57] pending further proceedings. The court's [36:00] resolution of their motion is dictated [36:02] by the application of well-known DC [36:05] circuit precedent that this court must [36:07] faithfully apply and for that reason [36:10] explained below the court will grant the [36:11] motion. This will be good to obtain a [36:15] temporary restraining order. Pliff must [36:17] show that he's likely to succeed on the [36:19] merits, that he's likely to suffer [36:20] irreparable harm in the absence of [36:22] preliminary relief, [36:24] and that the balance of equities tips in [36:27] his favor, and that an injunction is in [36:29] the public interest. [36:32] This is a high bar, but plaintiffs have [36:34] met it. He says, [36:37] "First, plaintiffs have shown a [36:38] likelihood of success, at least on their [36:40] fifth amendment procedural due process [36:43] claim." Okay, that's the giveaway. I'll [36:46] get to that in a minute. The merits of [36:48] this claim are assessed in two steps. [36:50] The first asks whether there exists a [36:53] liberty or property interest which has [36:55] been interfered with by the state. The [36:58] second examines whether the procedures [37:00] attended upon the deprivation were [37:02] constitutionally sufficient. Plaintiffs [37:05] have shown that they are likely to [37:06] succeed at both steps. So they have a [37:10] property interest [37:12] in their White House passes. They don't [37:14] have a property interest. That property [37:16] belongs to the White House, belongs to [37:18] the government. They have no property [37:21] interest. [37:25] Do I have a property interest? If I have [37:28] a pass to Fox News and in New York City [37:32] and they decide they don't want me [37:33] anymore and I say, "Wait a minute. Wait, [37:35] wait, wait. [37:37] I have a property interest in this past, [37:39] Mr. and I have every right to come into [37:41] the building. [37:46] As for the first, the DC circuit held [37:48] and they mentioned the case that the [37:51] interest of a bonafide or Washington [37:53] correspondent in obtaining a White House [37:55] press pass undoubtedly qualifies as a [37:58] liberty interest which may not be denied [38:01] without due process of law under the [38:03] fifth amendment. A liberty interest. [38:06] That's even more bizarre. So the pass, [38:09] the press pass is a liberty interest, [38:16] a liberty interest in a press pass to [38:20] get into the White House. I've never [38:23] heard anything so stupid. And I don't [38:25] care if the DC circuit said that. [38:27] Stupid. [38:30] And if there were any doubt about what [38:33] Cheryl meant, the DC circuit more [38:35] recently reaffirmed this conclusion in [38:37] KM versus Trump, holding that a [38:40] dulyisssued hard pass may not be [38:42] suspended without due process. Due [38:44] process. So listen to this. Just you, [38:48] Mr. and Mrs. America. The court [38:51] determines that it is a liberty right. I [38:55] don't even know what that means, but [38:56] it's a liberty right for the reporter [38:59] and the news organization to to be [39:01] issued and to have a pass from the White [39:05] House and that in order to remove it, [39:09] you have to comply with the fifth [39:11] amendment due process clause. Do you [39:12] believe that, Rich? [39:15] That's crazy. [39:20] Indeed, the Supreme Court he writes has [39:22] described the root requirement of the [39:24] due process clause as being that an [39:26] individual be given an opportunity for a [39:29] hearing before he's deprived of any [39:31] significant property interest. So before [39:34] a press group or reporter is told to [39:38] turn in their press pass, number one, [39:40] it's now a liberty interest and number [39:42] two, a fifth amendment federal due [39:45] process has to take place. [39:50] And the reporter must receive fair [39:52] notice not only of the conduct that [39:54] would subject him to punishment but also [39:57] the magnitude of the sanction that the [39:59] White House might impose. [40:01] This is all makeup by the circuit which [40:05] is heavily to the left Democrat [40:08] appointees. This is all makeup. This is [40:11] all BS. [40:15] Defendants do not dispute that [40:17] plaintiffs did not receive notice in an [40:19] opportunity to be heard before their [40:21] hard passes were revoked. And as in [40:24] Karem, the record is bereft of any [40:27] relevant formally articulated standards [40:30] in place before any of the conduct for [40:32] which defendants revoke their hard [40:34] passes. So now it's a liberty right, [40:39] federal due process. You must get [40:42] notice. You must have a right to be [40:44] heard, I guess, by the court. [40:47] And [40:49] the charges or the the bases for [40:52] removing the hard pass must be formally [40:55] articulated. What standards did we [40:58] violate? [41:01] This is crazy. Crazy. [41:06] One standard defendants appear to offer [41:08] reflected in letters they sent to [41:10] plaintiffs on September 22 identifying [41:12] their objectional reporting is so vague [41:14] it hardly does the trick. Your [41:17] organization has exhibited behavior in [41:19] violation of the standards of [41:20] professionalism at decorum expected of [41:23] those given access to the White House [41:24] complex. the White House said. Moreover, [41:26] defendants renewed plaintiffs Betsy [41:28] Klein's hard pass several months after [41:30] she published some of the identified [41:32] reporting, undercutting any argument [41:34] that she or employer, for example, had [41:36] the requisite notice that the conducted [41:39] issue violated a relevant standard. How [41:41] about how about just say, you know what, [41:44] you're out of here. That's all the [41:46] Constitution [41:49] The Constitution doesn't even deal with [41:51] this. [41:53] your right to access. Look at what [41:55] they've created here. They've created a [41:58] liberty right out of thin air. They've [42:00] created a due process right out of thin [42:02] air. They've required that standards be [42:05] articulated out of thin air. They've [42:07] required the right to notice out of thin [42:09] air. They've created the right to [42:11] somebody essentially to challenge it in [42:13] court out of thin air. Look at this. [42:18] None of defendants, that's the White [42:20] House arguments, convince the court that [42:22] plaintiffs are likely, excuse me, are [42:25] not likely to succeed on their due [42:27] process claim. Defendants say that [42:30] Cheryl and Kim were wrongly decided and [42:32] they are right. [42:34] Maybe, but this court is bound by DC [42:36] circuit president. Full stop. [42:40] You're bound by precedent, but you can [42:42] lay out the reasons why you're [42:43] concerned. [42:46] Defendants also point to the letters [42:48] referenced above, which they assert [42:50] afford plaintiffs post deprivation [42:53] notice of the revocations and an [42:56] opportunity to be heard. Post [42:59] deprivation notice [43:03] and defendants site cases that suggest [43:06] such a post-deprivation process suffices [43:09] in extraordinary circumstances. [43:12] These are such circumstances, defendants [43:15] argue, because plaintiffs have [43:16] endangered national security through [43:18] their reporting. Okay. But their [43:21] circumstances here are not so [43:22] extraordinary as to permit deviation [43:24] from the essential principle of due [43:26] process that a deprivation of liberty be [43:29] preceded by notice and opportunity for [43:31] hearing. [43:34] The case, the relevant case the judge [43:36] cites holds that post-deprivation due [43:38] process may suffice in unusual [43:41] situations such as when providing notice [43:44] before blocking it. It goes on and on. [43:48] Plaintiffs have shown that they are [43:49] likely to suffer irreparable harm absent [43:51] a temperate restraining order. The DC [43:54] circuit has long been established that [43:56] the loss of constitutional freedoms for [43:59] even a minimal period of time [44:01] unquestionably continues irreparable [44:03] injury. And what is the constitutional [44:06] freedom? What is it? [44:09] Now, the lower court could have delved [44:11] into that. What's the constitutional [44:13] freedom? Access to the White House. No, [44:16] I said what is the constitutional [44:19] freedom? [44:22] the news organization isn't being shut [44:24] down. [44:28] Thus, because plaintiffs [44:30] have shown the the news groups a [44:33] likelihood of success on at least one of [44:35] their constitutional claims, they've [44:37] also met the irreparable harm [44:39] requirement. [44:41] And what is the irreparable harm? The [44:44] liberty right. Their liberty right. [44:50] See, I would ask Judge Kelly, [44:53] let's say the Ku Klux Clan puts out a [44:56] very popular newsletter. Or better yet, [44:59] let's say Tucker Carlson, [45:02] the Qatari [45:04] in effect [45:06] anti-American Jewhating podcaster, [45:11] decides that [45:13] on the good days, you know, years ago [45:15] when it was just relatively normal, but [45:18] even then kind of freakish, but we'll [45:19] say relatively normal, that he got a [45:21] press pass [45:23] and the White House says, you know, [45:25] we're going to take your press pass [45:26] away. you're a jackass and you're a [45:28] mental case [45:30] and they take his pass away. Does he [45:33] have a liberty right? According to the [45:35] judge, he does. [45:37] He does. He has a liberty right in his [45:40] pass. [45:42] He has a liberty right in his pass. [45:48] This is just crazy. [45:51] plaintiffs in the public have an abiding [45:53] interest in maintaining the status quo [45:55] ante given the importance of the free [45:57] press which stands as one of the great [45:59] interpreters between the government and [46:00] the people. Okay, but it just so happens [46:04] that these three corporations [46:06] are not really interpreters between the [46:08] government and the people. They're [46:09] propagandists and that's the point [46:11] judge. [46:14] That's the point. And there's really no [46:16] denying that Politico is a radical left [46:20] Democratpromoting website. The [46:23] constipated news network is beyond the [46:25] pale. And then of course MS Now changed [46:29] its name to try and somehow conceal its [46:33] radicalism. [46:35] So we get down to it, don't we? What is [46:36] a news organization, judge? What is a [46:39] news organization? Can you tell us? [46:42] He doesn't go there. [46:45] And at some point somebody needs to [46:47] don't they judge [46:49] because that's the crux of the matter. [46:52] Not that they got to pass. [46:55] Not that it's a liberty right which is [46:57] absurd [46:58] and all the other attendant processes. [47:04] On the other side defendants argue that [47:05] revoking Plato's hard passes and [47:07] excluding them from the White House [47:08] serves an important national security [47:10] purpose. citing defendants interest in [47:13] protecting classified and sensitive [47:14] national security information. No doubt [47:17] protection in the national security is [47:19] awaiting interest on the executive [47:20] branch and tr and true uh courts of [47:24] limited competence in the area of [47:26] national security and so review of the [47:28] executive's related factual [47:29] determination should be highly [47:31] differential. Still on this record [47:34] defendants offer little to back up their [47:36] asserted national security interest to [47:38] justify revocation. See, ladies and [47:40] gentlemen, the courts are really [47:42] interfering [47:44] with what is an executive branch right [47:47] and function to make a determination [47:49] here. They're not violating the First [47:51] Amendment. The press is still free. [47:54] Nobody's shutting down Politico. [47:56] Nobody's really interfering with their [47:57] reporting. They can still go to events [47:59] where the president is and so forth and [48:01] so on. They just don't have access to [48:04] the White House. In fact, everybody [48:06] doesn't have access to the White House. [48:08] And what they seem to be saying is, [48:10] well, once you get a hard pass, it's [48:12] virtually impossible to take it away. [48:14] Doesn't it sound like that? You have a [48:16] liberty right under the First Amendment, [48:18] and you got to meet these 28,000 [48:21] processes in order to take it away. [48:25] Wow. [48:27] That ensures a responsible press. And by [48:30] responsible, I mean a real press, a news [48:31] organization. [48:36] For these reasons, plaintiffs have [48:38] satisfied the four-part winter factors [48:40] shown they are entitled to a temporary [48:42] restraining order. Two final points. [48:45] First, the court declines to stay this [48:46] temporary restraining order uh entry or [48:49] effective date is defendant's request. [48:52] Doing so runs against the purpose of [48:54] such an order, which is to immediately [48:57] but temporarily preserve the last [48:59] uncontested status quo while the [49:01] litigation proceeds. And in any event, [49:04] temporary restraining orders are [49:05] generally unappealable. [49:07] This temporary restraining order shall [49:09] remain in effect for 14 days, and the [49:12] court will set a schedule for expedited [49:15] briefing on a motion for a preliminary [49:17] injunction during that time. The court [49:19] will then be able to consider such a [49:21] motion with additional time and on a [49:23] fuller record. Well, I sure as hell hope [49:25] so, judge. You are you going to get to [49:27] the issue of what is a news organization [49:29] and what is a reporter? [49:31] And once they receive a pass, it's [49:34] virtually impossible to take it back. [49:39] Second, federal. Okay, you don't need to [49:41] know all that. [49:43] For all these reasons, it's ordered and [49:45] he orders it. Really shoddy, really [49:49] terrible. He acts like he's a [49:50] bureaucrat. Well, this is what the DC [49:52] circuit says. I agree with it and [49:55] nothing else I can do. Full stop. And [49:57] besides, look at the factual record [49:58] here. It underscores that and so forth. [50:01] and so on. If you're a really smart, [50:05] good constitutionalist, [50:09] you would be very, very troubled [50:13] by what this judge just did. [50:16] And if you were a judge who was a really [50:19] smart and true constitutionalist, [50:22] this would not be your ruling. [50:26] As you can see, the Constitution [50:30] protects none of this. [50:32] This is manufactured the liberty right. [50:36] At least he didn't go to the property [50:38] right, a liberty right, whatever that [50:40] means. [50:42] And of course, these news organizations, [50:44] so-called, are not prevented from [50:46] reporting news at all. They just can't [50:49] come into the president's house. From day one, [76:26] this particular person was determined [76:28] that the jury was going to find Rakawitz [76:32] not guilty by reason of mental disease. [76:35] jury four women. Louise Markle told the [76:38] AP at the time. [76:41] Meanwhile, Sunny Hston was quoted as a [76:44] juror on the case in multiple news clips [76:46] at the time, but she did not identify [76:48] herself as the hold out, nor did any of [76:51] the fellow jurors who talked to the [76:52] press after the trial. So, she may have [78:21] been one of the holdouts, but she may [78:22] have buckled. She may not have been on [78:24] the jury. She may have been, but may not [78:27] have buckled. And we need to [85:53] plead using this framework because we're [85:55] losing way too many cases across the [85:57] country in motions to dismiss where this [86:00] is avoided.
