Transcript [00:00] It's all quiet in the underground [00:03] bunker. Doors closed, locks bolted. But [00:07] the great one isn't just resting on his [00:10] laurels. He's making sure your weekend [00:12] is even better by giving you his best. [00:16] This is the best of Mark Lavven. [00:20] I'll just read to you what I just posted [00:22] or we're posting right now. [00:26] And I speak with you uh because I tell [00:28] you what I honestly feel. That's the way [00:29] we work here. [00:32] Certainly, one of the questions military [00:34] historians will have in the decades [00:35] ahead is why we did not arm the Iranian [00:38] people early in this war. A tremendous [00:40] asset left out of the war effort. [00:43] There doesn't appear to have been any [00:45] great effort to undertake this and why [00:48] we sideline the Israelis. Another huge [00:50] asset. [00:52] There was no reason to tap the brakes [00:54] early in this war and expectations of [00:57] negotiated settlements were overblown. [01:00] Then all the talk about non-existent [01:02] offramps. Maybe time for some new [01:04] advisors. It's worth a thought. [01:08] You think that's too uh too out there, [01:11] Mr. B? I don't. [01:14] And it's really consistent with [01:15] everything I've been saying for months. [01:18] For literally months. [01:21] So um there needs to be sort of a [01:24] counterweight to the isolationists and [01:27] the pacifists [01:29] in the administration and outside the [01:31] administration. [01:34] That's what I think. [01:36] US holds three hours of talks with Iran [01:38] on sidelines of the UN after Trump [01:40] threatened to drive them into hell [01:42] during a speech. [01:44] Well, [01:49] let's see how that turns out. [01:53] You know, every time we have this uh [01:56] challenge made, [01:58] we talk about it. We sit on the edges of [02:00] our seats and [02:04] they're not going to be driven into [02:05] hell. They have to be destroyed. [02:09] And in order to destroy them, it also [02:11] takes [02:14] people inside the country [02:17] seeking to destroy them, being armed, [02:20] and overtaking them. [02:23] And one of the reasons I'm troubled by [02:25] the sidelining of the Israelis is [02:27] because they they knew where a lot of [02:28] these bodies were buried, [02:31] so to speak. and maybe they're still [02:34] providing us with that information, but [02:38] you know, I'm not aware of too many [02:40] major military operations where we've [02:42] been incredibly successful, where we [02:45] have sidelined one of the most effective [02:47] allies on the face of the earth. [02:50] Why? Because Saudi Arabia doesn't like [02:52] it. Because Qatar doesn't like it. [02:55] Because Turkey doesn't like it. Who [02:56] cares? [02:58] Who cares what they like or don't like? [03:03] We need stark contrasts to win this [03:06] election. Stark contrasts [03:10] between us and them. [03:14] I was surprised the extent to which the [03:18] president Mandami met and talked [03:22] and I don't see Mandami patting the [03:24] president on the back. I don't see [03:25] Mandami [03:28] talking about certainly not publicly all [03:31] the wonderful things that he and the [03:33] president, the Republicans can do [03:35] together. [03:36] The president continues to put his hand [03:39] out, pats him on the back and so forth. [03:41] I don't see [03:44] an equivalent response. [03:48] But that's not even my point. My point [03:50] is he's a Marxist Islamist. [03:54] Uh, his Jew hatred is through the roof, [03:59] as is his wife. [04:02] Uh, his attacks on Netanyahu being a war [04:05] criminal are just outrageous. [04:10] What he's done to the city of New York [04:11] already and Republicans all over New [04:14] York and in the city are running for [04:16] office, pointing out what a disaster he [04:18] is. It doesn't help them. [04:23] when it is said how we can work together [04:26] and so forth and so on when he won't [04:28] work together. And if the Democrats win [04:30] the midterm elections, Mandami and the [04:33] DSA and the Democrats are going to go [04:36] full boore trying to destroy the [04:37] president, his family, the presidency, [04:39] and everything else [04:43] and everything else. He's again, he's [04:45] not somebody you can make a deal with. [04:48] He's a revolutionary [04:51] in my view. [04:53] in his view. [04:59] Um, [05:02] you got candidates running. You got [05:04] Bruce Blegman, a tremendous candidate [05:06] running for governor who lays into this [05:09] guy Mandami lays into Hokll. [05:12] And so you've got people out there might [05:14] be on the fence, might go one way or the [05:16] other. Not a lot, but but a few and [05:18] that's enough. Or saying, "Well, well, [05:20] now wait a minute. [05:22] You know today this was said about [05:24] Montami regardless of what Blakeman says [05:27] or somebody else says. You see my point, [05:29] Rich? [05:32] So the Republicans, the administration, [05:35] they need to be on message consistent [05:38] pounding away, pounding away, exposing [05:41] these people. They don't even have to, [05:43] you know, deceive anybody about who [05:45] these other people are. They are they [05:47] are raid revolutionaries. They are [05:49] extremists. [05:53] And you need to make that stark contrast [05:55] if you're going to win, especially if [05:56] you're going to win in a in a marginal [05:59] district, a marginal state, [06:02] or even in a purple or blue state or [06:04] district. You've got to make these [06:06] contrasts. Or why would a Democrat vote [06:09] Republican? They're going to say, "Okay, [06:11] well, if it's good enough for him, it's [06:12] good enough for me." [06:17] There need to be stark contrast, made. [06:19] So, what I'm seeing when I see the [06:21] rhinos kind of pulling out on their own, [06:24] I see some confusion about messaging and [06:27] a lack of stark contrast being made. [06:33] It's worrisome. It's troubling. [06:38] And we're going to do everything we can [06:39] to rally and to push, get the vote out, [06:45] but [06:47] everybody has to have their ore in the [06:49] water, going in the same direction, [06:51] paddling the same way. [06:54] Paddling the same way. [07:00] Circling back, the Iranian regime would [07:01] love nothing more than the Democrats to [07:03] take the House and the Senate and [07:05] Netanyahu to lose his election bid on [07:08] October 27th. [07:10] That will be a victory for them. And [07:12] there's no question about it. It will be [07:14] a victory for them. [07:18] No question about it in my mind. [07:24] And we have a lot of things to run on to [07:26] run on and against [07:29] with the Democrat party, their [07:31] radicalism, [07:33] their policies, [07:35] plus the so many of the policies that [07:37] have been put in place by the president, [07:38] the Republicans have been absolutely [07:40] superb. [07:42] Absolutely superb. [07:47] And pick three, four, five of them and [07:48] ram them home. Keep hitting it. Keep [07:50] hitting it. Keep hitting it. But we [07:53] can't have at the federal level, you [07:55] know, embracing Mandami, at the state [07:57] level trashing Mandami, at the local [07:59] level trashing him. Um, and then uh we [08:03] can't have these rhinos who go off on [08:06] their own [08:09] and uh [08:11] you know undermine the [08:15] the unity of the party and so forth and [08:18] so on. And this is what's happening. [08:19] Then we have another factor, the woke [08:21] right. R E I C. [08:26] Many of them want a defeat for the [08:28] Republicans because they view it as a [08:30] victory for them. [08:32] They also view it as an opportunity for [08:34] them. And they are going to say, "See, [08:38] Trumpism doesn't work. Conservatism [08:41] doesn't work. This doesn't work. The [08:43] Republican establishment, everybody's a [08:45] rhino." They don't know what the word [08:46] means, so they throw it around. [08:48] Everybody's a rhino. Follow us. the [08:51] nationalist populists. [08:54] We're not that big on the Constitution [08:56] either. You know, they're not. We're not [09:00] that big on capitalism either. We think [09:02] socialism lights the way to go. You've [09:04] heard them. You've heard them. Forget [09:08] about Israel and the Jews. Embrace the [09:10] Islamists and Islamism. That's the [09:12] future. That's where the votes are. [09:16] That's their position. [09:19] That's who they are. [09:23] and they will view this a defeat for the [09:26] Republicans as an opportunity for them [09:30] to remake the Republican party which [09:33] would be a complete disaster. We even we [09:36] have enough trouble as constitutional [09:38] conservatives dealing with the [09:39] Republican party. But that's their goal. [09:45] That's their goal. [09:49] big problem. [09:52] We're steady edddy here. I can't control [09:54] what the Republicans are doing. I can't [09:57] control what the White House does. I [09:59] can't control [10:01] what we do at the state level and so [10:03] forth. I'm not a general. I can't [10:05] control this war. I give you my opinions [10:07] on what I think are the best ways to [10:10] approach these things based on my [10:12] historical knowledge as well as [10:14] experience that you and I have [10:16] witnessed. [10:17] And whether it's the war or whether it's [10:20] the political process, [10:24] you know, I've I've witnessed a lot and [10:27] so have you and we've talked about it [10:28] together for nearly a quarter of a [10:30] century. We know how to win, [10:34] you and I. We know what it takes, [10:39] but do the others. [10:41] >> Mark [10:42] the VIN. [10:51] Making your weekend even better. This is [10:55] the best of Mark Leavvin. [10:57] >> Explain something to me, America. [11:01] There's a poll here that says 87% of the [11:03] American people think the government's [11:05] corrupt. Do you see that, Rich? [11:08] Well, if you think the government's [11:09] corrupt, nine out of 10 Americans, then [11:11] why would you support socialism, [11:14] which is all about government? Why is it [11:17] that we can't articulate these things? [11:19] It drives me crazy. I don't understand [11:20] it. [11:25] The president talking about Greenland, [11:27] which is a massive, massive uh victory [11:31] on his part. Cut six, go. As I announced [11:35] just days ago, the United States has [11:38] also reached an unprecedented agreement [11:40] regarding the northern frontier of North [11:43] America, the large and strategically [11:46] vital piece of land known as Greenland. [11:49] This agreement made with the Kingdom of [11:51] Denmark, an incredible, beautiful [11:53] country, and the Greenland people itself [11:58] gives the United States permanent [12:00] control over security and all other [12:02] needs on that territory. We will have [12:04] the complete ability to do what is [12:06] necessary to defend the American [12:09] continent and also Europe and other [12:12] places. No US adversary will ever be [12:16] permitted to establish a military [12:18] presence in Greenland anymore or make [12:20] sensitive investments there without our [12:22] express written approval. We will [12:24] immediately begin the process of [12:26] developing a large military presence in [12:29] the appropriate locations. We will be [12:32] building [12:33] two very major military bases. [12:37] >> Mhm. That is massive. And then when you [12:40] consider [12:41] the Chinese no longer control the Panama [12:44] Canal, [12:46] we do [12:49] uh that Venezuela is no longer just not [12:52] just a hot bed for that Marxist regime, [12:54] but for the Iranians, the Russians, and [12:56] the Chinese. [12:58] I mean, huge, huge accomplishments by [13:00] this president [13:02] truly. [13:04] And you consider the Democrats that [13:06] preceded him, a Biden or Obama, what [13:08] disasters. Good God. [13:14] You know, there's a great man who's [13:16] going to speak [13:18] Thursday at the United Nations. His name [13:20] is Benjamin Netanyahu. He's a dear [13:22] friend of the United States. [13:25] dear friend [13:28] and um I think he's more right on about [13:32] his take on Mandami than we are [13:37] than the White House is. [13:40] And he is a courageous tough dude. He's [13:42] battleh hardened in many respects [13:47] and he doesn't give a damn what Mandami [13:50] tries to pull to stop him from speaking [13:52] and so forth and so on. Cut nine go. [13:56] >> Shame on you, Mr. Mandani. Shame on you [13:59] for supporting the Hamas terrorist [14:01] monsters who butchered our people. Shame [14:03] on you for inciting riots against New [14:06] York Jews. I'm coming to the UN. I'm [14:09] going to tell the truth about our heroic [14:11] soldiers and I'm going to tell the truth [14:13] about you. [14:14] >> That's it. See, doesn't it make you feel [14:17] better, folks? Makes me feel better. [14:22] Oh, yeah. [14:25] Yep. [14:29] Mondami [14:32] at the U20 mayor's summit Saturday. [14:36] Cut 11. Go. And we must contend with a [14:39] moment where authoritarianism and [14:40] far-right movements are ascendant. When [14:43] anti-democratic sentiment is on the [14:45] rise, when leaders both in the United [14:47] States and overseas make it their [14:49] mission to demonize and terrorize [14:51] immigrants. [14:52] >> I assume he's talking about the [14:53] president leaders in the United States [14:55] and overseas. Go ahead. to accumulate [14:58] political capital by targeting our [15:00] LGBTQIA plus neighbors when they roll [15:03] back the freedoms that have been hard [15:04] won by the press or those fighting for [15:06] reproductive. [15:07] >> I I me I just speak for myself. I [15:09] couldn't sit down with this guy. I'd be [15:12] pulling my people together and say, "How [15:13] do we defeat him? Uh how do we confront [15:17] him? [15:18] How do we save the city of New York? [15:22] Um you know, give me a list of options [15:25] here." That's what I would do. That's [15:27] just me, you know. I'm not elected to [15:29] anything. [15:32] There's There's nothing I would want to [15:33] do with this guy. That's for sure. [15:35] Nothing. Zero. [15:37] And he's sending uh three of his [15:39] comrades who are every bit as crazy as [15:43] he is to the House of Representatives. [15:47] Now, you have leaders in the Democrat [15:49] party who are cowards who won't take the [15:51] guy on. And we can't have leaders in the [15:53] Republican party who talk about, you [15:56] know, working with them because then we [15:59] are paving the way for more of this. In [16:01] my opinion, just my opinion. [16:05] We're paving the way for more of it. [16:10] Mhm. [16:13] And Mandabi will be all in with [16:15] impeaching Trump when the time comes. [16:18] He'll be all in with kneecapping his [16:21] administration and trying to destroy it [16:22] when the time comes. [16:27] And again, we have people running [16:29] against him and hok his policies and hok [16:34] and uh we need stark contrasts that are [16:37] truthful and consistent from the top [16:40] down. Whoever speaking about these [16:42] things, you know, that's where I come [16:44] down. I bet that's where most of you [16:46] come down. [16:49] Chris Van Holland in an event Sunday. [16:51] Listen to this. 12 go. [16:54] >> I'm not concerned about DSA candidates. [16:55] My view is the Democratic Party should [16:58] be a big tent party and that we should [17:01] welcome debate and people who want to [17:04] shut down debate, they're afraid of [17:06] ideas. [17:07] >> No, no, no. We're not talking about [17:08] ideas. [17:10] We're talking about racists and bigots [17:12] and anti-semit. You're such a punk. You [17:15] are so disgusting. Go ahead. [17:18] >> Should be a big tent party. We should [17:20] welcome different ideas. You know, we [17:22] ask Democrats, as we should, to say, [17:24] "Let's elect Joe Mansion in West [17:26] Virginia because he's the guy who can [17:27] get elected in West Virginia." That's [17:28] great. I don't agree with Joe Mansion on [17:30] everything. And we should elect other [17:32] candidates like Zoran Mandani. [17:35] >> So, so, so the analysis just show you [17:37] how sick this guy is. is between Mansion [17:39] who's a moderate Democrat and Zora [17:42] Mandami who is a Marxist Islamist who [17:44] hates our country and promotes Hamas [17:47] big tent. You see we have both both in [17:49] there. Joe Mansion we did but he left [17:51] them. He's an independent now. And Zora [17:53] Mandami [17:57] seriously Marxist Islamists [18:00] in this guy's case who backs and [18:02] promotes Hamas [18:04] should be in our tent. See what I'm [18:06] saying folks? Go ahead. [18:09] >> I don't agree with them on everything [18:11] either, but they are bringing young [18:14] people and others, [18:15] >> you know, as adults, ladies and [18:17] gentlemen, it's our job to try and [18:20] to mold a future for young people that [18:23] try and get them excited about their [18:26] country and the founding and our to [18:28] become patriots and have allegiance to [18:30] the country. It's not to follow them. [18:35] follow Tik Tok, [18:37] follow Puker [18:39] to follow them? No, I don't think so. [18:43] I don't think so at all. And this is [18:44] part of the problem. The Democrats have [18:47] succeeded in taking over K through 12 [18:49] through these two radical Americanhating [18:52] unions, the NEA and the AFT. They've [18:54] succeeded in taking over 99% of our [18:57] colleges and universities with the 95 [19:00] 99% Marxist Islamist faculty. They've [19:04] succeeded in taking over most of the [19:06] media that gives voice to all of this. [19:10] And then we wonder what's the problem. [19:12] What's the problem? The problem is we [19:15] surrendered the culture or they took it [19:18] from we normal regular Americans. [19:22] >> Mark [19:23] Lavin. [19:29] You're listening to the best of Mark [19:32] Leavven. [19:33] >> You know, [19:35] Mees, the great Austrian economist, many [19:39] of you know, [19:40] said we all sound like Marxists now. [19:43] I've mentioned that before, haven't I, [19:44] Rich? [19:46] I would add, we all sound like appeasers [19:48] and isolacious now. [19:52] Would you agree with that, Rich, to a [19:54] great extent? [19:57] So maybe the left is one. [20:01] You know what I mean? [20:05] Maybe the left has already won [20:09] because we have a lot of people who [20:11] claim to be conservatives [20:14] but certainly don't sound like [20:21] because uh the so-called populists, [20:26] nationalists, [20:31] formerly conservatives [20:34] are starting to sound like the left, [20:37] at least to me. [20:41] And listen to what people say about this [20:44] war in Iran with the overwhelming [20:46] majority of the American people have no [20:48] direct role whatsoever, [20:50] no fear of a draft for young people [20:51] whatsoever. [20:54] And I think to myself, how the hell? [20:58] How the hell [21:00] did we win World War II? [21:04] Well, we were attacked. Well, Iran has [21:05] attacked us again and again and threaten [21:07] us with nuclear weapons. We have to wait [21:10] to be hit with a nuclear weapon. [21:14] How the hell did we even form an army to [21:16] fight the Korean War, the Vietnam War? [21:19] I mean, I sit here and I wonder [21:26] a gallon of gasoline that's going to [21:28] determine the election. I don't think [21:30] so. There is multiple issues. Nature of [21:33] the candidate, the nature of the [21:34] message, how united and coordinated [21:38] these campaigns are, the strategies that [21:40] are being used, and on and on and on. We [21:43] know the history of off-year elections [21:45] about incumbents and presidential and [21:48] the party of the president and how they [21:49] do. And there's a lot [21:53] In fact, let me do this. [21:56] I posted about this earlier. [22:00] And you know, when I post things, I give [22:02] them a little thought. Sometimes a lot [22:04] of thought. So, I don't just plop them [22:06] up there. [22:08] I don't just plop them up there. Let's [22:11] see here. [22:13] One moment. Let's see here. I'm going to [22:16] read this to you. [22:19] Give me a second. [22:21] The reason so many people, young, excuse [22:23] me, the reason so many young people have [22:25] moved left is because of the failure to [22:28] get our K12 schools under control. The [22:31] radical teachers unions who brainwashed [22:33] the kids. because of the failure to get [22:35] our colleges under control and we [22:38] allowed them to be populated with [22:39] tenured Marxist Islamist faculties and [22:42] DEI personnel because of massive legal [22:45] and illegal immigration from the third [22:47] world and a lack of vetting and [22:49] assimilation [22:51] because of the massively increased role [22:52] of government in every aspect of our [22:55] economy creating all kinds of [22:56] disincentives and financial dislocation. [23:00] So now for some it appears their [23:02] response and their answer is listen to [23:04] the kids and accommodate their demands. [23:07] Yet just two years ago Trump won a [23:09] landslide election and held both houses [23:11] of Congress. But listen to the kids. [23:15] Look, this is a tough election cycle and [23:18] it always was going to be a tough [23:19] election cycle. For starters, we know [23:22] the history of off-year elections for [23:24] incumbent presidents. Obama got his butt [23:27] kicked in 2010 by the Tea Party. I was [23:29] an integral part of it. But they doubled [23:32] down. And now look at the Democrat [23:34] party, the DSC, infiltration of Marxist [23:36] Islamists. They never abandoned their [23:38] radical ideology, but they hit the gas [23:40] pedal. There's certainly things we can [23:42] do better. No question about that. I [23:45] have a list of them, including the lack [23:46] of a decisive victory in Iran, rather [23:49] than early on tapping the brakes and [23:51] seeking a premature deal. So be it. [23:54] There's precious little time left. [23:56] Rather than starting postelection doomer [23:58] fingerpointing and positioning oneself [24:01] as if a sage when seeing the obvious 6 [24:04] weeks before the actual election, how [24:07] about we put our minds and resources and [24:09] efforts toward fighting as hard as we [24:11] can given all that is at stake. You can [24:14] be concerned and say so, but stop [24:16] dispiriting voters before they vote. You [24:19] could be creating a self-fulfilling [24:21] outcome. Shove the predictions. [24:24] Let's get going. [24:27] They hear very quick to talk about how [24:29] banning how it's we've never seen [24:31] anything like this and so forth and so [24:32] on. Of course, we've seen a lot worse as [24:34] I've discussed over and over again and [24:36] is in my book on freedom of the press. I [24:38] write these books for a reason. [24:42] We have people who don't write their [24:44] books. They have they edit their books [24:47] or maybe they'll write part of their [24:48] books and they line up for attention. [24:50] said, [24:52] "Some of them I like the books, some of [24:55] them I don't." But this argument that [24:58] the First Amendment grants press access [25:00] to the White House has some serious [25:03] hurdles. If the judge is going to be [25:05] serious about it, I want you to think [25:06] about this. What are the credentials for [25:09] getting a White House pass? And are they [25:12] legitimate at all? If so, does a judge [25:16] determine whether the credentials meet a [25:18] freedom of the press test? [25:20] And what is the test? And why should a [25:23] judge make that determination? What [25:25] about press outfits that are denied [25:28] access because of say contentbased [25:30] decisions? For example, let's say it's a [25:33] clan group with a newsletter or Hamas [25:35] group with a podcaster. [25:38] With the explosion of new media [25:39] platforms, how is this to be dealt with? [25:42] Audience size? Surely not. Politico is [25:46] essentially a website. CNN is a [25:48] low-rated cable channel. MS Now is not [25:51] much better. All three are highly [25:53] partisan for Democrats. [25:56] How can some of these press outfits get [25:58] access while others are denied? But how [26:01] can all be granted press access when [26:03] even as a practical matter, it would be [26:05] impossible to fit them all in the White [26:07] House press room? A judge who decides [26:10] access is press freedom will have a lot [26:14] of explaining to do. [26:17] It doesn't mean he won't try, but we [26:19] shall see if that is the case, whether [26:21] it makes any sense. [26:23] Then we have somebody called Nostra [26:25] Dummy. Get someone to explain to you [26:27] slowly how the White House press poll [26:29] works and always has worked. And what [26:31] they're talking about is one press [26:33] person, [26:34] you know, who covers it and then No, [26:37] we're talking about a press conference, [26:38] a-hole, you You don't even [26:40] understand what we're talking about. [26:42] Nostra dummy. [26:44] You understand? [26:46] Lots of dummies out there. They're [26:48] online. They use fake names. [26:52] But we notice, [26:54] we still notice them. [26:58] And then we have this guy Viceman. [27:02] Remember Viceman? [27:04] He was on the Mueller staff. Remember, [27:06] as a prosecutor, [27:08] remember he was also a top lieutenant [27:12] to James Comey years ago when he was FBI [27:15] director. viceman and now he's shown his [27:18] true colors. He's a radical left-wing [27:20] hack. He's a ghoul. [27:23] He's all these things. He should never [27:25] been anywhere near the FBI unless he was [27:27] under investigation. Should never been [27:29] anywhere near the prosecutor's office [27:30] unless he was being charged. [27:33] But that's okay. MS Now brings him on [27:35] the other day. And here's his genius. [27:38] Hat tip media research center. Cat 10. [27:41] Go. Um, I I wanted to just take a quick [27:44] moment to point out something about the [27:47] president reaching for something that is [27:49] so blatantly unconstitutional and for [27:52] people to understand it is not about CNN [27:56] or MSN Now or Politico. It is about the [27:58] right of people to get the news and to [28:02] hear the news. [28:02] >> No, it's not about the right of people [28:04] to get the news and hear information. [28:07] They can still report all the news that [28:10] they want. they can get all of the [28:11] information that they want [28:15] just because they don't have a special [28:17] place in the press room. [28:22] But keep in mind the questions that I [28:24] raised. How is this decided? And with [28:26] new media, and there's so much new [28:28] media, on what basis are people cut out [28:31] cuz you can't have everybody. Go ahead. [28:34] choose. In the 1930s in Germany, William [28:39] Shyer and other foreign journalists were [28:42] required by the German [28:44] >> weird accent, doesn't he, Mr. Booer? [28:48] >> I'd say has a weird accent. Go ahead. [28:50] >> Um, when they were reporting on the [28:53] growth of national socialism of the Nazi [28:56] party. [28:56] >> Well, let me tell you something, Andrew. [29:00] When Franklin Roosevelt was president, [29:03] your great hero, [29:07] radio companies back then got a [29:09] three-year license from the government. [29:11] He cut it to 6 months and he put his own [29:15] media campaign person at the head of [29:17] what was called the Federal Radio [29:19] Commission. They changed it to Federal [29:21] Communication Commission [29:24] and they threatened NBC and CBS [29:30] with pulling their licenses. [29:33] And in fact, NBC's president put out a [29:35] statement that we will in fact support [29:37] the New Deal. Did you know that, Andrew? [29:41] That was the 1930s actually. [29:45] Yes, it was. [29:48] That's right. [29:50] What do you make of the press covering [29:52] up the Holocaust in the 1940s there? [29:55] Andrew Weissman [29:58] in part at the REQUEST OF FRANKLIN [30:00] ROOSEVELT. WHAT DO YOU THINK of that [30:02] one? Andrew. [30:04] Andy. Let's call him Andy. Would you [30:06] like Andy, Mr. Producer? [30:09] Go ahead. [30:11] >> Wired before they could report to their [30:13] home countries. [30:15] >> What would you think about Franklin [30:16] Roosevelt? [30:18] the chairman in the Senate, excuse me, [30:21] Colorado chairman in the Senate, [30:24] a special Democrat committee, they [30:26] control all the government back then. [30:29] And they insisted that the Western Union [30:32] Telegraph Company provide all their [30:34] telegraphs over a period of time to the [30:38] committee Democrats so they could review [30:41] them for communications. [30:43] They objected to the subpoenas, [30:46] but then they relented. [30:50] They sent in 20 government officials [30:53] into the headquarters of the Western [30:55] Union Company to go over telegraphs and [30:58] they looked at millions of them over the [31:00] course of years to see what lobbyists [31:03] were saying, senators and congressmen [31:05] were saying, ALL WORTH ALL UNDER THE [31:07] GREAT FRANKLIN ROOSEVELT. WHAT DO YOU [31:09] think of that, Andy? [31:12] Does that bother you? Here's another one [31:14] with the great Franklin Roosevelt. He [31:17] unleashed the Internal Revenue Service [31:19] against the man who founded and owned [31:22] the Philadelphia Inquire, which was [31:24] considered a Republican newspaper in [31:26] Philadelphia. [31:30] Name was Annenburgg. [31:35] And they tried to break Annenburgg [31:37] because his editorials weren't [31:38] supporting the New Deal. [31:42] That was the 1930s in America. Andy, did [31:46] you know that, Andy? I thought I would [31:48] tell you about that. Andy. Oh, yes. Oh, [31:51] yes. [31:53] Want to hear more? [31:55] Barack No, Bonito Obama unleashed the [31:58] FBI against the Associated Press. Yes, [32:02] he did. Yes, he did. AND THE FBI TAPPED [32:06] INTO 20, count them, 20 of their phone [32:09] lines. That's right. That's right. They [32:10] did. They did. [32:13] They went after James Horizon [32:16] of the New York Times, a lefty editorial [32:18] writer. Oh, yes, they did. And [32:23] Fox News is James Rosen who texts me [32:26] from time to time. He wants radio time. [32:28] Anyway, [32:30] they went after him. They went after his [32:32] parents. They did all those things. [32:36] Yes. [32:38] That was in the 2000s. And I don't [32:40] remember Andy Viceman Viceman. I don't [32:43] remember Andy Viceman saying anything [32:45] about it. I DON'T REMEMBER CORY BOOKER [32:48] SAYING ANYTHING about it. I DON'T [32:51] REMEMBER ANYBODY SAYING ANYTHING ABOUT [32:53] it except me. [32:56] Whole chapter in my book. [33:00] All these things happened. [33:02] Should we go to Woodro Wilson, the great [33:04] Woody Wilson? [33:06] Oh yes. He imprisoned scores, hundreds [33:12] of so-called journalists. He did the [33:16] first progressive president. Well, I'd [33:17] say Theodore Roosevelt was. I don't [33:19] think the White House quite under [33:20] understands what Theodore Roosevelt [33:22] stood for, but nonetheless, nonetheless, [33:26] Woody Wilson. [33:28] Yes, he imprisoned reporters. He did. [33:32] And he imprisoned just PEOPLE WHO [33:34] DISAGREED WITH HIS AGENDAS. 1,200 OF [33:36] them sent to federal prison. It's true. [33:40] It's true. [33:42] It's true. [33:45] Want to get into wiretaps? You want to [33:47] get into John Kennedy and LBJ? Huh? Huh? [33:50] Do you? Do you, Andy? Do you, Cory? Mark [33:55] the Vin. [34:04] The Great One makes your weekend even [34:07] better. This is the best of Mark Leven. [34:11] I have to be honest. I always am. I [34:15] can't get all worked up and excited [34:17] about G's visit to our country. Can you, [34:19] Mr. Producer? [34:21] This guy's building the biggest military [34:23] imaginable other than ours [34:26] for the purpose of threatening us and [34:29] Japan and Australia and New Zealand and [34:32] South Korea and [34:35] so forth and so on. [34:37] This guy with the virus did enormous [34:40] damage to our country, killed a lot of [34:42] people in this country, made a lot of [34:44] people quite sick in this country and [34:46] did damage to our economy. [34:49] And this guy is stealing us blind like [34:51] the F-35 parts, [34:54] stealing AI critical information. [34:58] He's providing satellite imagery to the [35:01] Iranian Nazi regime in Thyron to kill [35:05] our service people and so forth. And so [35:07] I can't I just can't get worked up in a [35:10] positive way about this guy and I'm not [35:11] going to. [35:13] That said, I know the president is not [35:15] just about pomp and circumstance here. [35:18] And it's crucially important that we not [35:21] make any deal with them on AI, on [35:24] artificial intelligence. It really is [35:26] critical because they will steal us [35:29] blind. And I might add while I'm at it, [35:32] same with the Iranian regime that now [35:33] says they want a deal before the midterm [35:35] elections. Why? [35:39] This is, as I've been saying for years, [35:42] a civilizational battle. A [35:44] civilizational battle. We, the [35:46] civilized, against the barbarians. They [35:49] don't view this as a nation state versus [35:51] a nation state. [35:54] They just want to survive. [35:57] Which brings me to Benjamin Netanyahu. [36:00] Wow, what a blockbuster speech that was [36:02] at the United Nations. I'm just saying. [36:05] I want you to keep something in mind. [36:08] He is the prime minister of a country of [36:10] about 10 million people. A country that [36:13] is it's not even the size of New Jersey [36:17] and yet has one of the most powerful [36:20] militaries on the face of the earth. [36:22] Most powerful technologies on the face [36:24] of the earth, a very vigorous economy [36:27] and a people who are willing to fight [36:28] for their survival. They have a will to [36:30] live. [36:34] It's one thing to be a leader and we [36:37] have them all over the world of big [36:39] countries with big populations and big [36:41] militaries and big economies. [36:44] It's another thing to be a leader of a [36:46] very small country with a very small [36:48] population that is geographically vulner [36:51] vulnerable to god knows how many [36:54] terrorist enemies, terrorist states, [36:57] armies and so forth and so on. That's [37:00] different. [37:02] That takes a special kind of individual. [37:05] And Netanyahu has been prime minister [37:07] off and on there for 14 years. And if [37:10] the Israelis are smart, they're going to [37:12] elect him again. [37:16] Here he was at the UN today. I want our [37:20] Persian friends to take a listen. They [37:22] know because nobody speaks better and [37:25] louder and more aggressively on behalf [37:28] of the Persian people, the Iranian [37:30] people, than Benjamin Netanyahu. [37:33] Cut 23. Go. [37:35] >> Despite your silence, despite your [37:38] hypocrisy, it's only a matter of time [37:41] that in Iran, something incredible will [37:45] happen. The power of the people will [37:48] overcome the people in power. [37:54] I want you to listen to my words [37:57] carefully. One day, and it may not be [38:01] far away, the Iranian people will be [38:05] free. Their murderous regime will be [38:08] toppled by its lies, by its corruption, [38:11] by its cruelty. This evil regime will [38:15] fall, and we will all celebrate that [38:18] day. [38:19] Amen to that. [38:22] Amen to that. [38:26] Cut one. Mr. Producer, go. [38:28] >> Devastating Iran's nuclear facilities [38:32] was hard. [38:34] It was very hard to do. [38:38] But for me, [38:40] it was one of the easiest decisions I've [38:43] ever had to make as prime minister. [38:46] Because if we hadn't done it, [38:49] we'd all be dead. [38:52] Now, you want to hear the ultimate irony [38:56] in defending itself? [38:58] Israel is alo also defending many of the [39:02] countries whose delegates just left this [39:05] hall. [39:06] In fact, [39:08] I want you to know that many of their [39:11] leaders even thank us privately for [39:14] taking out Iran's nukes. [39:18] It's hard to imagine more mindblowing [39:20] hypocrisy, but that's exactly what it [39:22] is. [39:23] >> It is. And it's hard to imagine in our [39:26] own country [39:28] where you have people like former [39:30] Congressman Matt Gates [39:33] who's rooting for Hamas against Israel, [39:37] who's rooting for Iran against our [39:40] military, who claims to be a MAGA [39:43] America first as he trashes what the [39:46] commander-in-chief has been trying to do [39:48] now for months. And he's not alone. We [39:51] have an entire woke Reich REIC, [39:54] an entire woke right movement, [39:56] isolationists, some of them even [39:58] neofascists, [40:01] who are undermining our midterm [40:02] elections, who are giving aid and [40:04] comfort to our enemies. And then they [40:07] claim to be the real patriots. You see, [40:11] the real patriots. [40:14] And look at the backgrounds of these [40:15] people. They're former congressmen and [40:18] congresswomen for a reason. [40:22] Some of them are stuck behind podcast [40:24] for a reason. They've been to prison. [40:28] They have plead guilty to stay out of [40:29] prison. It's amazing. [40:33] And it's not just the woke right, [40:37] isolationists, and neofascists. [40:40] We've got people like Hassan Puker. [40:45] But there's not a great difference [40:46] between a Hassan Pucer and a no pants [40:49] Matt Gates. [40:51] Their views overlap on a lot of things. [40:54] Their Jew hatred, their Israel hatred, [40:57] their Netanyahu hatred. [41:01] They overlap on a lot of things. [41:05] They simply do. Here's Netanyahu at the [41:07] UN today. Cut two. Go. In this battle [41:11] against the barbarians, [41:13] we've had no greater partner than [41:16] President Trump. I thank him. [41:19] >> Amen. Amen. [41:24] >> I thank him for his bold leadership. [41:27] He boldly confronted an enormous danger [41:30] to America, Israel, and the world. [41:34] Decades ago, he understood that if left [41:37] unchallenged, the fanatic Ayatollas who [41:40] chant death to America, death to Israel, [41:44] would eventually carry out their mad [41:46] fantasies. [41:48] >> So, Israel and America acted together [41:52] not only to protect ourselves, [41:54] but to save civilization. [41:58] Brave American pilots alongside brave [42:01] Israeli pilots flew joint missions over [42:04] the skies of Iran. America and Israel [42:08] also work together to bring back our [42:11] remaining hostages. We brought back [42:14] every last one of them. [42:24] You ask why are we winning? Well, Yonyi [42:27] said it simply, "We have no other [42:30] choice." [42:32] his older brother who died in Antbi [42:38] he told the story and I'll just truncate [42:40] it here but [42:42] when he talked to his brother the 67 war [42:45] 1967 [42:48] wondering if they can win [42:51] and his older brother Yoni said we have [42:54] no other choice [42:57] we have to [43:02] This is truly a heroic individual. [43:06] Israel has been fighting [43:08] the war of Western civilization against [43:11] the barbarians. [43:13] And before President Trump joined Israel [43:16] and Israel joined us, they were pretty [43:19] much on their own [43:21] with Obama and Biden who were funding [43:23] the enemy, who were appeasing the enemy. [43:26] And you see this is the problem with the [43:28] woke right isolationists and the [43:30] neofascists. This is the problem with [43:32] former no pants congressmen like Gates [43:36] and so forth and so on. They really push [43:40] the Biden Obama agenda. [43:44] They appease to the terrorist states and [43:46] the enemies. [43:49] They give aid and comfort to the Iranian [43:51] regime and all their surrogates. They [43:53] give aid and comfort domestically. [43:56] to the Muslim Brotherhood. They give [43:58] aiding comfort to Hassan Puker Mandami [44:03] and his ilk. [44:07] The enemy is not [44:10] Donald Trump. The enemy is not [44:13] Benjamin Netanyahu. The enemy is not the [44:16] United States. The enemy is not Israel. [44:23] We're the good guys. [44:26] with the very good guys. [44:28] >> Mark [44:29] the Vin. [44:36] >> We're giving you nothing but the best [44:38] the best of Mark Leven, United States [44:41] District Court for the District of [44:43] Columbia. One of the things I regret [44:45] that the Republicans haven't done [44:48] is uh to change the makeup of the DC [44:52] lower courts and circuit court and to [44:55] move a lot of these these judges. First, [44:58] we'll remove several of them. You don't [44:59] have to do it through impeachment. just [45:00] eliminate their courthouse and eliminate [45:03] their jurisdiction [45:06] and create [45:08] some of these judgeships and some of [45:09] these courouses outside of the [45:12] Washington DC metropolitan area [45:16] because it has a poisonous effect on [45:18] their brains. [45:21] And that's the case with Judge Kelly, a [45:24] Trump appointee 2017. [45:27] I don't know who recommended him. I [45:29] don't know how he got there. I'd never [45:31] heard of him before, but so be it. Cable [45:34] News Network, CNN [45:37] versus Donald J. Trump. [45:40] It's only eight pages. [45:43] On the afternoon of September 18, 2026, [45:46] President Trump announced in a social [45:48] media post that effective immediately [45:50] was banning the news organization CNN, [45:53] MSN Now, and Politico from the White [45:56] House. And those news organizations [45:58] alleged that over the weekend their [46:00] reporters were denied access to the [46:02] White House and had their hard pass [46:04] press credentials deactivated. [46:07] Plaintiffs the three news organizations [46:09] and three individual reporters sue the [46:11] president and several White House [46:13] officials and move for a temporary [46:14] restraining order at TTRO asking the [46:17] court to order the immediate [46:18] reinstatement of their hard passes [46:19] pending further proceedings. The court's [46:22] resolution of their motion is dictated [46:24] by the application of well-known DC [46:27] circuit precedent that this court must [46:29] faithfully apply and for that reason [46:32] explained below the court will grant the [46:33] motion. This will be good. To obtain a [46:37] temporary restraining order, pliff must [46:39] show that he's likely to succeed on the [46:41] merits, that he's likely to suffer [46:42] irreparable harm in the absence of [46:44] preliminary relief, [46:46] and that the balance of equities tips in [46:49] his favor, and that an injunction is in [46:51] the public interest. [46:54] This is a high bar, but plaintiffs have [46:56] met it. He says, "First, plaintiffs have [47:00] shown a likelihood of success at least [47:02] on their fifth amendment procedural due [47:05] process claim." Okay, that's the [47:07] giveaway. I'll get to that in a minute. [47:09] The merits of this claim are assessed in [47:11] two steps. The first asks whether there [47:14] exists a liberty or property interest [47:17] which has been interfered with by the [47:18] state. The second examines whether the [47:21] procedures attended upon the deprivation [47:24] were constitutionally sufficient. [47:26] Plaintiffs have shown that they're [47:28] likely to succeed at both steps. So they [47:31] have a property interest [47:34] in their White House passes. They don't [47:36] have a property interest. That property [47:38] belongs to the White House, belongs to [47:40] the government. They have no property [47:43] interest. [47:47] Do I have a property interest? If I have [47:50] a pass to Fox News and in New York City [47:54] and they decide they don't want me [47:55] anymore and I say, "Wait a minute. Wait, [47:57] wait, wait. [47:58] I have a property interest in this past, [48:01] Mr. Badus, and I have every right to [48:02] come into the building." [48:08] As for the first, the DC circuit held [48:10] and they mentioned the case that the [48:13] interest of a bonafide or Washington [48:15] correspondent in obtaining a White House [48:17] press pass undoubtedly qualifies as a [48:20] liberty interest which may not be denied [48:23] without due process of law under the [48:25] fifth amendment. A liberty interest. [48:28] That's even more bizarre. So the pass, [48:31] the press pass is a liberty interest, [48:38] a liberty interest in a press pass to [48:42] get into the White House. I've never [48:45] heard anything so stupid. And I don't [48:47] care if the DC circuit said that. [48:49] Stupid. [48:52] And if there were any doubt about what [48:55] Cheryl meant, the DC circuit more [48:57] recently referred this conclusion in KM [49:00] versus Trump, holding that a dyisss [49:02] issued hard pass may not be suspended [49:05] without due process. Due process. So [49:08] listen to this. Just you, Mr. and Mrs. [49:11] America. The court determines that it is [49:14] a liberty right. I don't even know what [49:17] that means, but it's a liberty right for [49:20] the reporter and the news organization [49:22] to to be issued and to have a pass from [49:26] the White House and that in order to [49:29] remove it, you have to comply with the [49:32] fifth amendment due process clause. Do [49:34] you believe that, Rich? [49:37] That's crazy. [49:42] Indeed, the Supreme Court he writes has [49:44] described the root requirement of the [49:46] due precious clause as being that an [49:48] individual be given an opportunity for a [49:50] HEARING BEFORE he's deprived of any [49:53] significant property interest. So before [49:56] a press group or reporter is told to [50:00] turn in their press pass, number one, [50:02] it's now a liberty interest and number [50:04] two, a fifth amendment federal due [50:07] process has to take place. [50:12] And the reporter must receive fair [50:14] notice not only of the conduct that [50:16] would subject him to punishment but also [50:19] the magnitude of the sanction that the [50:21] White House might impose. [50:23] This is all makeup by the circuit which [50:27] is heavily to the left Democrat [50:30] appointees. This is all makeup. This is [50:33] all BS. [50:37] Defendants do not dispute that [50:39] plaintiffs did not receive notice in an [50:41] opportunity to be heard before their [50:43] hard passes were revoked. And as in KM, [50:47] the record is bereft of any relevant [50:50] formally articulated standards in place [50:53] before any of the conduct for which [50:55] defendants revoke their hard passes. So [50:57] now it's a liberty right, federal due [51:02] process. You must get notice. You must [51:05] have a right to be heard, I guess, by [51:06] the court. [51:09] And [51:11] the charges or the the bases for [51:14] removing the hard past must be formally [51:17] articulated. What standards did we [51:19] violate? [51:23] This is crazy. Crazy. [51:27] One standard defendants appear to offer [51:30] reflected in letters they sent to [51:32] plaintiffs on September 22 identifying [51:34] their objectional reporting is so vague [51:36] it hardly does the trick. [51:39] Your organization has exhibited behavior [51:41] in violation of the standards of [51:42] professionalism at decorum expected of [51:44] those given access to the White House [51:46] complex. The White House said more of a [51:48] defendant's renewed plaintiff's Betsy [51:50] Klein's hard pass several months after [51:52] she published some of the identified [51:54] reporting undercutting any argument that [51:57] she or her employer for example had the [51:59] requisite notice that the conducted [52:01] issue violated A RELEVANT STANDARD. HOW [52:03] ABOUT HOW ABOUT JUST say you know what [52:06] you're out of here. That's all the [52:08] Constitution [52:11] THE CONSTITUTION DOESN'T EVEN DEAL WITH [52:13] THIS. [52:15] YOUR RIGHT TO ACCESS. LOOK AT WHAT [52:17] THEY'VE CREATED HERE. They've created a [52:20] liberty right out of thin air. They've [52:22] created A DUE PROCESS RIGHT out of thin [52:24] air. They've required that standards be [52:27] articulated out of thin air. They've [52:29] required the right to notice out of thin [52:31] air. They've created the right to [52:33] somebody essentially to challenge it in [52:35] court out of thin air. Look at this. [52:40] None of defendants, that's the White [52:42] House arguments, convince the court that [52:44] plaintiffs are likely, excuse me, are [52:47] not likely to succeed on their due [52:49] process claim. Defendants say that [52:52] Cheryl and Kim were wrongly decided and [52:54] they are right. [52:56] Maybe, but this court is bound by DC [52:58] Circuit President. Full stop. [53:02] You're bound by precedent, but you can [53:04] lay out the reasons why you're [53:05] concerned. [53:08] Defendants also point to the letters [53:10] referenced above which they assert [53:12] afford plaintiffs postdeprivation [53:15] notice of the revocations and an [53:18] opportunity to be heard. Post [53:21] deprivation notice [53:25] and defendants site cases that suggest [53:27] such a post-deprivation process suffices [53:31] in extraordinary circumstances. [53:34] These are such circumstances, defendants [53:37] argue, because plaintiffs have [53:38] endangered national security through [53:40] their reporting. Okay. But their [53:43] circumstances here are not so [53:44] extraordinary as to permit deviation [53:46] from the essential principle of due [53:48] process that a deprivation of liberty be [53:51] preceded by notice and opportunity for [53:53] hearing. [53:56] The case, the relevant case the judge [53:58] cites holds that post-deprivation due [54:00] process may suffice in unusual [54:03] situations such as when providing notice [54:05] before blocking that. It goes on and on. [54:10] Plaintiffs have shown that they are [54:11] likely to suffer irreparable harm absent [54:13] a tempor restraining order. The DC [54:16] circuit has long been established that [54:18] the loss of constitutional freedoms for [54:21] even a minimal period of time [54:23] unquestionably continues irreparable [54:25] injury. And what is the constitutional [54:28] freedom? What is it? [54:31] Now, the lower court could have delved [54:33] into that. What's the constitutional [54:35] freedom? Access to the White House. NO, [54:38] I SAID WHAT is the constitutional [54:41] freedom? [54:44] the news organization isn't being shut [54:46] down. [54:50] Thus, because plaintiffs [54:52] have shown the the news groups a [54:55] likelihood of success on at least one of [54:57] their constitutional claims, they've [54:58] also met the irreparable harm [55:01] requirement. [55:03] And what is the irreparable harm? The [55:06] liberty right. Their liberty right. [55:12] See, I would ask Judge Kelly, [55:15] let's say the Ku Klux Clan puts out a [55:18] very popular newsletter. Or better yet, [55:21] let's say Tucker Carlson, [55:24] the Qatari [55:26] in effect [55:28] anti-American Jewhating podcaster, [55:33] decides that [55:35] on the good days, you know, years ago [55:37] when it was just relatively normal, but [55:40] even then kind of freakish, but we'll [55:41] say relatively normal, that he got a [55:43] press pass [55:45] and the White House says, you know, [55:47] we're going to take your press pass [55:48] away. you're a jackass and you're a [55:50] mental case [55:52] and they take his pass away. Does he [55:54] have a liberty right? According to the [55:57] judge, he does. [55:59] He does. He has a liberty right in his [56:02] pass. [56:03] He has a liberty right in his pass. [56:10] This is just crazy. [56:13] plaintiffs in the public have an abiding [56:15] interest in maintaining the status quo [56:17] ante given the importance of the free [56:19] press which stands as one of the great [56:21] interpreters between the government and [56:22] the people. Okay, but it just so happens [56:26] that these three corporations are not [56:28] really interpreters between the [56:30] government and the people. They're [56:31] propagandists and that's the point [56:33] judge. [56:36] THAT'S THE POINT. AND THERE'S REALLY no [56:38] denying that Politico is a radical left [56:42] Democratpromoting website. The [56:44] constipated news network is beyond the [56:47] pale. And then of course MS Now changed [56:51] its name to try and somehow conceal its [56:55] radicalism. [56:56] So we get down to it, don't we? What is [56:58] a news organization, judge? What is a [57:01] news organization? Can you tell us? [57:04] He doesn't go there. [57:07] At some point, somebody needs to, don't [57:09] they, judge? [57:11] Because that's the crux of the matter. [57:14] Not that they got to pass, [57:17] not that it's a liberty right, which is [57:19] absurd, [57:20] and all the other attendant processes. [57:26] On the other side, defendants argue that [57:27] revoking Plato's hard passes and [57:29] excluding them from the White House [57:30] serves an important national security [57:32] purpose, citing defendants interest in [57:35] protecting classified and sensitive [57:36] national security information. No doubt [57:39] protection of the national security is a [57:41] waiting interest on the executive branch [57:43] and tr and true uh courts of limited [57:47] competence in the area of national [57:48] security and so review of the [57:50] executive's related factual [57:51] determination should be highly [57:53] differential. Still on this record, [57:56] defendants offer little to back up their [57:57] asserted national security interest to [58:00] justify revocation. See, ladies and [58:02] gentlemen, the courts are really [58:04] interfering [58:06] with what is an executive branch right [58:09] and function to make a determination [58:11] here. They're not violating the First [58:13] Amendment. The press is still free. [58:16] Nobody's shutting down Politico. [58:18] Nobody's really interfering with their [58:19] reporting. They can still go to events [58:21] where the president is and so forth and [58:23] so on. They just don't have access to [58:26] the White House. In fact, everybody [58:28] doesn't have access to the White House. [58:30] And what they seem to be saying is, [58:32] well, once you get a hard pass, it's [58:34] virtually impossible to take it away. [58:36] Doesn't it sound like that? You have a [58:38] liberty right under the First Amendment, [58:40] and you got to meet these 28,000 [58:43] processes in order to take it away. [58:47] Wow. [58:49] that ensures a responsible press. And by [58:52] responsible, I mean a real press, a news [58:53] organization. [58:58] For these reasons, plaintiffs have [59:00] satisfied the four-part winter factors [59:02] shown they are entitled to a temporary [59:04] restraining order. Two final points. [59:07] First, the court declines to stay this [59:08] temporary restraining order uh entry or [59:11] effective date as defendants's request. [59:14] Doing so runs against the purpose of [59:16] such an order, which is to immediately [59:19] but temporarily preserve the last [59:21] uncontested status quo while the [59:23] litigation proceeds. And in any event, [59:26] temporary restraining orders are [59:27] generally unappealable. [59:29] This temporary restraining order shall [59:31] remain in effect for 14 days and the [59:34] court will set a schedule for expedited [59:37] briefing on a motion for a preliminary [59:39] injunction. During that time, the court [59:41] will then be able to consider such a [59:43] motion with additional time and on a [59:45] fuller record. Well, I sure as hell hope [59:47] so. Judge, you are you going to get to [59:49] the issue of what is a news organization [59:51] and what is a reporter? [59:53] And once they receive a pass, it's [59:56] virtually impossible to take it back. [60:01] Second, federal. Okay, you don't need to [60:03] know all that. [60:05] For all these reasons, it's ordered and [60:07] he orders it. really shoddy, really [60:11] terrible. He acts like he's a [60:12] bureaucrat. Well, this is what the DC [60:14] circuit says. I agree with it and [60:16] nothing else I can do. Full stop. And [60:18] besides, look at the factual record [60:20] here. It underscores that and so forth [60:23] and so on. If you're a really smart, [60:27] good constitutionalist, [60:31] you would be very, very troubled [60:35] by what this judge just did. [60:38] And if you were a judge who is a really [60:41] smart and true constitutionalist, [60:44] this would not be your ruling. [60:48] As you can see, the Constitution [60:52] protects none of this. [60:54] This is manufactured [60:56] liberty right. [60:58] At least he didn't go to the property [61:00] right, a liberty right, whatever that [61:02] means. [61:04] And of course, these news organizations, [61:06] so-called, are not prevented from [61:08] reporting news at all. They just can't [61:11] come into the president's house.
